Focus Orange Technology B.V. (hereafter: Crunchr) may process data of clients, prospects, website visitors, job applicants, and the data of employees of clients. This privacy policy informs you how we process these categories of data. Note that we distinguish between data of visitors of this website (clients, potential clients, jobs applicants, and other people interested in Crunchr) and data in the Crunchr cloud solution (data of employees of clients).

Crunchr will ensure to comply with the applicable privacy regulations.

Additionally, the privacy and security statements of the Crunchr cloud solution can be found on our support portal which is accessible for clients and prospects (login available on request).

We periodically update this Privacy Policy. We post any privacy policy changes on this page and, if the changes are significant, we will send a notification by e-mail to clients and prospects who have chosen to receive email communications from us.


Data of visitors of this website

Why we collect this data? 

Crunchr collects and processes personal data for legitimate business purposes which include:

  • Product updates and offers.
  • Information about best practices, use cases, and other research by our team.
  • Information about new events and/or event invitations.

Please note that we only collect data that is necessary for the purposes mentioned above.

What data do we collect? 

Crunchr collects and processes the following data:

  • Personal data of visitors (including but not limited to name, e-mail, and job title)
  • Organizational data of visitors (including but not limited to company name and office location).

Data storage 

Crunchr processes the data as described above as long as you are a subscriber.

IP and cookies

Crunchr may store your IP address after it is communicated to our web site via your device. In addition, Crunchr may use cookies to provide our services.

Sub processors 

For our customer relationship management we use HubSpot. This CRM system helps us to identify and target our customers more efficiently. Your information, such as your name and e-mail address, is transferred to HubSpot for processing in accordance with their Privacy Policy. Crunchr also sends content via HubSpot and MailChimp. By being on our newsletter list (after your subscription request and confirmation), you acknowledge that your information, such as your name and e-mail address, is transferred to HubSpot or MailChimp for processing in accordance with their Privacy Policies.

Legal basis on what we do with your data 

Crunchr processes your IP address only to allow your device to establish a connection to our webserver over the Internet. This processing is based on Art. 6 par. 1 lit. f) GDPR. This same article is applied when you contact us by email or by using a contact form. The purpose as well as our legitimate interest is to answer your inquiry.

Job applications at Crunchr are processed different. We process your application for the purpose of the recruitment process. The legal basis for this is Art. 6 par. 1 lit. b) GDPR and Art. 88 GDPR in connection with a national law, if the relevant country adopted national laws for the protection of employee data.

Information sharing 

Crunchr will never sell your data to third parties. In addition, Crunchr will not share your data with third parties, unless this is under your approval. Hence, Crunchr will only share your data with other organizations if this is necessary for special occasions (e.g. registering for events via MailChimp).

Right of access, rectification, and erasure 

You as a person will always have the right to:

  • Access your data processed by Crunchr;
  • Update and/or add your data processed by Crunchr;
  • Remove your data processed by Crunchr.

Requests regarding access, rectification or erasure of personal data processed by Crunchr should be send to our Data Protection Officer below.

Data in the Crunchr cloud solution

Why we collect this data?

Crunchr collects and processes data of the employees of clients to deliver our core products:

  • Crunchr Workforce: generate insights on your current workforce.
  • Crunchr Planning: generate workforce scenarios for the future.
  • Crunchr Preference: execute employee preference surveys.

Please note that we only collect data that is necessary for the purposes mentioned above.

What data we collect?

Crunchr collects and processes the following data:

  • Personal data of employees (including but not limited to name, age, sex, job title, salary, and appraisal score)
  • Organizational data of clients (including but not limited to reporting lines, succession plans, cost centers, business units, and legal entities).

Clients can add custom data elements that are not part of our standard data model (e.g. languages spoken by an employee), but Crunchr will refuse to process special categories of data as specified by the GDPR (e.g. race, religion, or sexual orientation).

Data storage 

Crunchr processes the data as described above as long as you are a client.

IP and cookies

Crunchr may store your IP address after it is communicated to our cloud solution via your device. In addition, Crunchr may use cookies to provide our services.

Sub processors 

For our data processing we use selected hosting companies in the European Economic Area that are ISO 27001 certified and are able to comply with Crunchr security and privacy policies. Your data will be stored in storage solutions of these hosting companies, protected by means of encryption and/or other technical security measures that ensure the hosting companies will have no regular access to your data.

Currently, we use CloudVPS as a hosting company, who operate out of several data centers located in Amsterdam, The Netherlands.

Legal basis on what we do with your data

Crunchr processes your data to deliver our services to you. This processing is based on Art. 6 par. 1 lit. f) GDPR. You as employer have a legitimate need to manage your workforce: doing appraisals, setting salaries, and shaping the organization, like any company does, except now you do it in our cloud solution instead of by traditional means. In your data processing agreement with Crunchr we address this in more detail. Included in this agreement is your authorization for us to perform this processing.

Right of access, rectification, and erasure 

You as a client will always have the right to:

  • Access your data processed by Crunchr;
  • Update and/or add data processed by Crunchr;
  • Remove your data processed by Crunchr.

Data subjects (employees of clients) who want to exercise these rights must do so via their employer, the client of Crunchr.

Anonymization, pseudonymization, retention periods, and returning of your data in an agreed format upon termination of the service are arranged in a customized manner based on the requirements you specify. We are very flexible, can accommodate any need, and will gladly refine or adapt the agreed arrangements when you require so during the contract period.
